Scattering Africa

Terms and Conditions of Use

These Terms and Conditions govern your use of this website and any services provided through it. By accessing this site or using the service, you agree to be bound by these Terms.

If you do not agree, please do not proceed.

Scope of the service

This service provides the handling and scattering of a portion of cremated remains in southern Africa, as described on the website.

The service begins only once cremated remains have been physically received by us in Africa. Any arrangements made prior to that point fall outside our control.

Responsibility for transport

You are responsible for arranging the transport of cremated remains to us.

This includes:
• Selecting a carrier or transport provider
• Ensuring compliance with all shipping, customs, and documentation requirements
• Packaging the urn in accordance with carrier rules

We do not accept responsibility for loss, delay, damage, or refusal of shipment while remains are in transit to us.

Our responsibility begins only once the remains have been received and accepted by us.

Partial remains

The service operates using partial remains only.

The amount sent is determined by you, typically in consultation with your funeral service provider and based on the container selected. We do not verify, measure, or confirm quantities supplied.

Third-party services

This website may reference or link to third-party services, including payment platforms, retailers, and transport providers.

These services operate independently. We do not control their actions and are not responsible for their performance, errors, or omissions, even where recommendations are provided for convenience.

Scattering locations and timing

Locations are subject to availability, access, environmental conditions, and local requirements.

While reasonable efforts are made to carry out the service as described, exact timing and conditions cannot be guaranteed. We reserve the right to adjust locations where necessary to ensure compliance, safety, or practicality.

Confirmation of completion

Once the service has been completed, we provide confirmation in the form described on the website. This confirmation represents completion of the service.

Limitation of liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential loss
    • We are not liable for emotional distress or loss arising from circumstances beyond our control
    • Our total liability, where applicable, is limited to any amount paid directly to us for the service

As the core scattering service is provided at no cost, liability is correspondingly limited.

Force majeure

We are not liable for failure or delay in performing the service due to events beyond our reasonable control. This includes, but is not limited to:

  • Natural events
    • Government or regulatory restrictions
    • Border or customs actions
    • Transport disruptions
    • Environmental or access limitations

Use of the website

You agree to use this website lawfully and not in a way that causes harm, disruption, or misuse of the service or information provided.

Governing law

These Terms are governed by the laws of South Africa.
Any disputes are subject to the exclusive jurisdiction of South African courts.

Changes to these Terms

We may update these Terms from time to time. The most current version will always be available on this website.
